The Federal Trade Commission (FTC) on Wednesday announced that it has reached an agreement with CVS, Rite Aid and Walmart to settle a number of lawsuits filed against the company over the sale of certain prescription drugs. The agreement, however, does not allow for generic substitution of certain drugs, such as Viagra and Cialis, from the market.
The FTC reached a similar agreement in November, agreeing to pay a portion of the settlement to two generic retailers, according to a letter sent by CVS and Wal-Mart to the FTC. The FTC said that it has received from the two companies, claiming that the settlement is fair and appropriate and that they are complying with all applicable regulatory requirements.
The FTC said that the settlement was in the form of a “black letter,” indicating that it was aware of the suit filed against the retailers. The FTC has not yet publicly commented on the settlement.

The FTC has not said how many cases of generic substitution are being taken by the retailers and what their costs will be. CVS said that it will file a lawsuit against Walmart to recover the costs of its generic products.
Wal-Mart also said that it has settled some cases of “non-pharmacy drug purchase,” such as Viagra, that it is “notifying consumers that this was a case for which the FDA did not approve the generic version.”
